Terms and Conditions

VAT and Overseas Orders

Prices on the website are calculated in GB Pounds inclusive of VAT.  The Shopping Cart and Checkout pages will display the net (ex-VAT) prices, with VAT added to the subtotal for UK customers only. Overseas customers, including from Europe, will be charged at the applicable rate.

Terms and Conditions

Nothing in these Terms and Conditions shall affect the Customer’s statutory rights as a consumer.

Acceptance of delivery of the Goods shall be deemed the Customer’s acceptance of these Terms and Conditions.

Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by Lavinia Stamps.

Orders placed via the web site

Orders cannot be added to, combined or amended once placed.

Any orders for Goods shall be deemed to be an offer to purchase, pursuant to these Terms and Conditions, subject to acceptance by Lavinia Stamps. Lavinia Stamps may choose not to accept an order for any reason.

In the event items ordered are not available from stock, we will refund the cost of the item(s) and send the remaining items of the order out to you.

Prices and Payment

The Price of the Goods shall be that stipulated on the Lavinia Stamps Website.

The total purchase price, including any VAT and delivery charges, if any, will be displayed in the Customer’s shopping cart prior to confirming the order.

After the order is received Lavinia Stamps shall confirm the description and price by email.

Payment including any VAT and/or delivery charges must be made in full before the order is dispatched.

We do not store credit card details nor do we share customer details with any 3rd parties.
Seller’s Rights

Lavinia Stamps reserves the right to alter the price and specification of any item on the Web site at its discretion.

Lavinia Stamps reserves the right to withdraw any goods from the Web site at any time.

Lavinia Stamps shall not be liable to anyone for withdrawing any Goods from the Web site or for refusing to process an order.

Warranty

Lavinia Stamps warrants that the Goods will at the time of dispatch correspond to the description given. All other warranties, conditions, or terms relating to fitness for purpose, merchantability or condition of the Goods, whether implied by Statute, common law or otherwise are excluded and the Customer is satisfied as to the suitability of the Goods for the Customer’s purpose.

Delivery

Orders will usually be dispatched by Royal Mail within 48 hours of receipt, excluding weekends and public holidays. Should we be away attending a show or exhibition, a notice to this effect will be displayed on the website and in these circumstances, it may take up to ten working days for goods to be dispatched.

If an item is out of stock, we will refund the cost of the item(s) and send the remaining items of the order out to you.

Lavinia Stamps will use all reasonable endeavour to meet any date agreed for delivery. In any event, time of delivery shall not be of the essence and Lavinia Stamps shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

Delivery of the Goods shall be made to the Customer’s address specified in the order and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

Title and risk in the Goods shall pass to the Customer upon delivery of the Goods.

Returns

The Customer shall inspect the Goods immediately upon receipt and shall notify Lavinia Stamps within 14 working days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Customer fails to do so the Customer shall be deemed to have accepted the Goods. Lavinia Stamps will not accept the return of the Goods at a later date.

Where a claim of defect or damage is made the customer should contact our Customer Service Team via email and include pictures showing the fault. The customer will be informed of the returns procedures and, should a fault be confirmed, the Customer shall be entitled to a replacement of the product plus a refund of any return postal charges.

In such an eventuality, the item(s) returned by the Customer should be adequately insured during the return journey. Where returned Goods are found to be damaged due to the Customer’s fault, the Customer will be liable for the cost of remedying such damage and any postal charges.

Limitation of Liability

Except as may be implied by law, in the event of any breach of these Terms and Conditions by Lavinia Stamps the remedies of the Customer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and Lavinia Stamps shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

Force Majeure

Lavinia Stamps shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and Lavinia Stamps shall be entitled to a reasonable extension of its obligations.

Changes to these Terms and Conditions

Lavinia Stamps shall be entitled to alter these Terms and Conditions at any time. This right shall not affect the existing Terms and Conditions accepted by the Customer upon making a purchase.

Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
